1. Introduction
- This Agreement governs use of the Online Tax Program. Use indicates full acceptance of all terms; if not accepted, discontinue use.
- Headings are for convenience only and have no legal effect. Additional page-specific disclaimers may supplement these terms.
2. Exclusion Of Warranties
- No warranties for accuracy or uninterrupted service; no liability for errors, interruptions, viruses, unauthorized access, or other failures.
- No liability for direct, indirect, incidental, special, or consequential damages from use or inability to use the service.
3. Your Use And Responsibilities
- Limited, non-exclusive, non-transferable license to access and use the Online Tax Program via the provided HTML interface only.
- No impersonation, misrepresentation, modification, or use of modified versions to obtain unauthorized access.
- Review all returns for accuracy; state returns derive from federal data provided by the user.
4. No Refund Policy
- All submitted orders are final; no cancellations or refunds. Disputed charges may be validated with a copy of the prepared return.
5. Intellectual Property
- All rights in the Tax Program and content are reserved. No reverse engineering, sublicensing, framing, or commercial access allowed.
- License may be terminated upon breach; use must cease immediately upon termination.
6. Indemnify
- User agrees to indemnify and hold harmless the company and affiliates against claims arising from submitted data or rights violations.
- Company may assume exclusive defense with separate counsel; user will cooperate fully.
7. Username, Password, and Security
- User must keep credentials secure and accurate; logout on public terminals and protect stored data.
- Account and tax information may be retained as required by law and to provide services.
8. Accuracy Of Tax Program
- No warranty that all deductions will be found or that the program is error-free; users are responsible for complete and accurate input.
- Acceptance by tax authorities is not guaranteed; documentation may be required by authorities.
9. Acceptance Of Limited Guarantees
- Limited remedies only; no liability for indirect, special, incidental, or consequential damages.
10. Severability
- Certain exclusions or limitations may not apply in some jurisdictions; remaining provisions remain enforceable.
11. Self-Prepared Tax Returns
- E-filing offered for personal returns for the last 3 years; others may require paper filing.
- Software can be used to self-prepare returns back to 2000, but refunds typically only for the last 3 years.
12. Form 8879
- User authorizes e-filing; certain states may require paper filing if federal is not e-filed.
- Bank details must be correct; misdirected refunds due to incorrect details are the user’s responsibility.
13. Privacy Policy
- Privacy Policy is available on the site and may change; users are responsible for reviewing updates.
14. Class Action
- User waives the right to participate as representative or member of a class for claims subject to arbitration, except where a class is already certified at acceptance.
15. Force Majeure
- No liability for delays or failures due to events beyond control, including natural disasters, labor disputes, war, terrorism, or government actions.
16. Choice Of Law
- Governing law: State of New York; exclusive jurisdiction in courts located in Queens County, New York.
17. We Reserve The Right
- Terms and the Online Tax Program may be modified, suspended, or discontinued at any time without notice.
- Eligibility for products/services is subject to final approval and acceptance.
